제품 및 문서의 위조･사기 범죄 대응 관련 ISO 국제표준 고찰
이 연구는 제품 및 문서 관련 범죄의 예방 시스템 측면에서 국제표준기구인 ISO를 통해 서 표준화되어 가는 추세를 분석한 것이다. 제품 위조나 문서를 통한 사기의 방지와 같은 악의적 공격에 의한 리스크를 관리하고 손실을 방지하기 위한 산업재산권 보호 관련한 기 술, 프로세스, 방법론, 체계 등에 대한 표준화가 가속화되어 가고 있다. 우리나라에서도 이 러한 글로벌 표준화의 내용을 인지하고 조속히 대응하여 무역장벽 문제를 극복해야 한다. 이런 맥락에서 제품 및 문서 보안 관련 표준화의 구체적인 내용을 분석하여 시사점을 도출 하였다. ISO 22380 ‘제품사기 방지의 일반 원칙’, ISO 22383 ‘유형재화의 위조방지에 사용 되는 진품입증 솔루션의 성능기준’, ISO 16678 ‘상호운용 가능한 상품식별과 위조･불법거 래 방지를 위한 진품입증 시스템 지침’, ISO 22381 ‘위조 및 불법 거래 방지를 위한 객체식 별시스템 간의 상호운용성 수립 지침’, ISO 22382 ‘소비세 납세증지의 내용, 보안, 발행 및 검사 지침’ 등 일반원칙, 입증솔루션, 입증시스템, 납세증지 보안지침에 관한 총 5개의 국제표준을 분석하였다. 시사점은 제품 및 문서 보안 위협의 다양화되어 가고 있으며 이러 한 다양하고 글로벌화 되어 가는 제품 및 문서의 위조･사기 공격에 대응하는 리스크평가 기반의 제품 및 문서 보안 표준들이 확대되어 가고 있어서 우리나라에서도 부합화 노력 등이 긴요하다는 점이다. 또한 보안 관련 예방, 대비, 대응, 회복에 이르는 전 라이프사이클 에 보안을 위한 공공기관과 민간기업, 개인 소비자에 대한 교육, 홍보, 보안 인프라의 구축, 상호 커뮤니케이션 등 투자 노력과 협업, 그리고 정보의 교환 및 소통을 강조하는 파트너 십 접근이 요구된다는 점이다. 나아가 이러한 보안 관련 산업기술 표준화에 제대로 대응하 거나 대비하지 못하면 무역기술장벽(TBT) 통보 건수가 증가하여 수출기업의 해외 기술규제에 장애요인이 될 수 있으므로 효율적인 TBT 대응체제의 확보를 위해 산업통상자원부 국가기술표준원과 전문위원회의 전문성과 체계성의 확보가 중요하다는 점이다.
Analysis of ISO International Standards for the Prevention of Counterfeiting and Fraud of Products and Documents
The study analyzed trends being standardized through ISO, an international standards body, in terms of prevention systems for product and documentation-related crimes. Standardization of technologies, processes, methodologies, and systems related to protecting industrial property rights to manage risks from malicious attacks, such as prevention of fraud through product forgery or documentation, is accelerating. Korea should also recognize the contents of such global standardization and respond as soon as possible to overcome the trade barrier problem In this context, specific aspects of product and document security-related standardization have been analyzed to derive implications. ISO 22380 General Principles for Product fraud prevention, ISO 22383 Performance Criteria for Genuine Verification Solutions used to prevent counterfeit of tangible goods, ISO 16678 Guidelines for the Proof of Original Product Identification, ISO 16678 Guidelines for the Interoperable Commodity Identification and the Proofing of the Realty System for the Prevention of Counterfeit and Illegal Transactions, ISO 22382 Security Taxation, etc. The implications are that product and document security threats are becoming more diversified, and risk-based product and document security standards are expanding in response to fake and fraudulent attacks on various and globalizing products and documents, which require concerted efforts in Korea. In addition, the entire lifecycle of security-related prevention, preparedness, response and recovery requires a partnership approach that emphasizes investment efforts and collaboration, including training, promotion, deployment of security infrastructure, and mutual communication, as well as exchange and communication of information. Furthermore, the number of trade technology barriers (TBT) notices may increase if they fail to properly respond to or prepare for standardization of security-related industrial technologies, thus it is important to secure expertise and systematicness of the National Institute of Technology and the Specialized Committee of the Ministry of Trade, Industry and Energy to secure an efficient TBT response system.
